Who we are
These Terms and Conditions (“Terms”) govern your use of the Arviah platform, including the website at arviahstudio.com and the client application at app.arviahstudio.com (together, the “Platform”), and any services provided through it. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
The Platform is operated by Arviah (“Arviah”, “we”, “us”, or “our”). Our registered address and contact details are available on the Contact page of our website.
Definitions
“Client” means any individual or business that submits a project brief on the Platform.
“Maker” means any verified jewellery manufacturer registered to bid on projects via the Platform.
“Project” means a custom jewellery brief submitted by a Client.
“Bid” means a proposal submitted by a Maker in response to a Project, including proposed price, timeline, and materials.
“Order” means a confirmed agreement between a Client and a Maker following the Client’s acceptance of a Bid.
“Services” means all services provided by Arviah via the Platform.
Eligibility & Account Registration
To use the Platform you must be at least 18 years of age and capable of entering into a legally binding contract. By registering an account, you confirm that the information you provide is accurate and that you will keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.
The Arviah Platform Role & Responsibility
Arviah operates as a marketplace and facilitation platform. We connect Clients with verified Makers but are not a party to the contract for the manufacture of jewellery between a Client and a Maker. The contract for manufacture is formed directly between the Client and the Maker upon acceptance of a Bid.
Notwithstanding the above, Arviah:
– Verifies all Makers before they are permitted to participate on the Platform;
– Oversees production quality and timelines;
– Facilitates communication between Clients and Makers;
– Arranges insured delivery on behalf of the Client and Maker;
– Provides dispute resolution services in the event of a disagreement between Client and Maker.
Project Submissions & Bidding
Clients may submit Projects free of charge. Submitting a Project does not create any obligation to accept a Bid. Once a Client accepts a Bid, an Order is created and the Client agrees to the price, timeline, and specification set out in that Bid.
Makers agree that all Bids are submitted in good faith, reflect a genuine ability to fulfil the Project, and comply with the material and quality specifications described. Makers may not submit Bids that are misleading or that they do not have the capacity to fulfil.
Payment
Payment terms, including deposit requirements and final payment schedules, will be set out within the platform at the point of Order confirmation. All payments are processed via secure payment infrastructure integrated into the Platform. Arviah holds payments in escrow where applicable until production milestones are met, as detailed in the Order.
All prices are inclusive of applicable taxes unless otherwise stated. Currency is Indian Rupees (INR) unless explicitly indicated otherwise.
Cancellations & Refunds
Once an Order is confirmed, cancellation requests must be submitted to krish@arviahstudio.com. Whether a refund is available depends on the stage of production at the time of the cancellation request:
– Cancellation before production begins: full refund of any amounts paid, subject to any non-refundable platform fee.
– Cancellation after production has begun: partial refund may be available at Arviah’s discretion, taking into account materials already purchased and work already completed.
– Cancellation after the piece has been dispatched: no refund will be issued unless the piece does not conform to the agreed specification or arrives damaged.
Bespoke and custom-made goods are generally exempt from standard statutory cancellation rights. However, Arviah’s own refund policy (set out above and in our FAQs) operates alongside any statutory rights you may have and is not intended to limit them.
Quality, Disputes & Remedies
Arviah is committed to ensuring that every piece meets the agreed specification. If you believe your order does not meet the brief or has arrived damaged, you must notify us at krish@arviahstudio.com within 48 hours of delivery, providing photographic evidence.
Arviah will investigate and may, at its discretion, arrange for:
– Repair of the piece;
– A remake by the original Maker or an alternative verified Maker; or
– A full or partial refund.
Arviah’s decision following investigation is final, subject to any statutory rights you may have.
Intellectual Property
All content on the Arviah Platform, including branding, design, text, images, and software, is owned by or licensed to Arviah and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Platform without our prior written consent.
By submitting a Project, you grant Arviah a non-exclusive, royalty-free licence to use images, descriptions, and other content you upload solely for the purposes of operating the Platform and facilitating your Project.
User Conduct
You agree not to use the Platform to:
– Submit false, misleading, or fraudulent information;
– Infringe the intellectual property rights of any third party;
– Engage in any unlawful, abusive, or fraudulent activity;
– Circumvent the Platform’s payment systems to transact directly with Makers outside of Arviah.
Arviah reserves the right to suspend or terminate accounts where these Terms are breached.
Limitation of Liability
To the fullest extent permitted by applicable law, Arviah’s total liability arising out of or in connection with the Platform shall not exceed the total amount paid by you to Arviah in the 12 months preceding the event giving rise to the claim. Arviah is not liable for indirect, consequential, or incidental losses, loss of profits, or loss of data.
Nothing in these Terms limits Arviah’s liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
Governing Law
These Terms are governed by the laws of India. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of India.
Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes via email or a notice within the Platform. Your continued use of the Platform following any changes constitutes your acceptance of the updated Terms.
